Terms of Service

These Terms of Service (the “Terms”) govern your access to and use of LumiiCare, the home-health operations platform available at getlumiicare.com and its related applications (the “Service”), operated by LumiiCare (“we”, “us”). By creating an account or using the Service, you agree to these Terms.
1. The Service
LumiiCare provides software for home-care and home-health agencies, including scheduling, electronic visit verification, timesheets, payroll preparation, invoicing, credential tracking, reporting, and the Lumii AI assistant. We may add, change, or remove features over time.
2. Accounts & eligibility
You must provide accurate information, keep your credentials secure, and be responsible for all activity under your account. You must be able to form a binding contract and use the Service only for lawful business purposes on behalf of your agency.
3. Subscriptions, free trials & billing
- Paid plans are billed monthly in advance at the price shown at sign-up. Prices are in US dollars.
- Where a free trial is offered, its length and terms are shown at sign-up.
- Subscriptions renew automatically each period until cancelled.
- We may change prices or plans; we will give reasonable notice, and changes apply from your next billing period.
- Payments are processed by our payment provider (Paystack). We do not store your full card details.
4. Cancellation & refunds
You can cancel anytime from Billing → Cancel subscription, or by contacting us. Cancellation stops future renewals; details, including our refund terms, are in our Refund & Cancellation Policy.
5. Your data & responsibilities
- You and your agency own the data you enter (staff, clients, schedules, visits, timesheets, etc.) and are responsible for its accuracy and for having the right to provide it.
- You are responsible for complying with laws that apply to your agency, including employment, wage-and-hour, and healthcare privacy laws.
- Where the data includes protected health information (PHI), LumiiCare acts as your service provider/business associate. A Business Associate Agreement (BAA) is available and, where applicable, must be in place before PHI is processed.
6. Acceptable use
Do not misuse the Service: no unlawful, infringing, or harmful activity; no attempts to breach security or access data you are not authorized to see; no reselling the Service without our permission.
7. Intellectual property
The Service, including its software and branding, belongs to LumiiCare. We grant you a limited, non-exclusive, non-transferable right to use it during your subscription. Your data remains yours.
8. Third-party services
The Service relies on third parties (for example, hosting, email, payment processing, and AI providers). Their handling of data is described in our Privacy Policy.
9. Disclaimers
The Service is provided “as is” without warranties of any kind. LumiiCare supports agency operations but does not provide legal, tax, payroll, or clinical advice, and is not a substitute for your professional judgment.
10. Limitation of liability
To the maximum extent permitted by law, LumiiCare is not liable for indirect or consequential damages, and our total liability is limited to the amounts you paid us in the 12 months before the claim.
11. Termination
You may stop using the Service at any time. We may suspend or terminate access for breach of these Terms or non-payment. On termination you may request an export of your data for a reasonable period.
12. Changes to these Terms
We may update these Terms; we will post the updated version here and, for material changes, provide notice. Continued use means you accept the changes.
